Since July 25, 2009, the "Ordinance on the Participation of Electronic Mobility Aids in Traffic" allows Segway use throughout Germany. The legislature has issued regulations on this subject, which can be read at www.gesetze-im-internet.de/bundesrecht/mobhv/gesamt.pdf.

Range of services

2.1 The Segway Tour Cologne & Segwaypoint-Düsseldorf & Seg-Events,

conducts sightseeing tours and Segway courses for events, park and sports festivals as well as promotional activities with Segways. The following terms and conditions apply to all of these service offers. They also apply if alternative mobility aids are used instead of Segways.
2.2 Contractual partners and participants in Segway tours and Segway courses are hereinafter referred to as customers.

has the right to set a minimum number of participants per tour. Generally this is at min. 4 participants. Due to discount campaigns, vouchers and special promotions the minimum number of participants can be changed. The customer will be informed in time if the minimum number of participants is not reached.

Conditions of participation

3.1 A driver's license is no longer necessary since 15.06.2019.

3.2 The road traffic regulations apply to Segway tours.

3.3 The use of the Segways provided by us, the participation in a Segway tour or a Segway course are always at your own risk and at the customer's own risk. The customer must confirm this without limitation by signing a disclaimer.

Safety instructions for Segway tours

would like to do everything to make your Segway tour a special experience. Each tour is accompanied by a guide. Before the tour begins, you will receive a briefing on how to ride the Segway. Only when you have familiarized yourself extensively with Segway riding and have learned the skills necessary for safe handling in traffic, such as accelerating, braking, steering as well as safe mounting and dismounting, and feel capable of riding the Segway independently and safely, should you participate in the tour. The instruction time is part of the booked tour duration.

4.2 If you do not feel confident to take the tour after the briefing, the customer will not be refunded the tour price.

4.3. the guide has the right to decide after the briefing for safety reasons if a participant cannot go on the tour (e.g. because of unsafe driving endangering the other participants). In this case, the customer will not be refunded the tour price.

4.4 Follow the instructions of your guide during the tour. Follow him at the pace he sets or ask him to slow down if necessary. Collisions of Segways are to be avoided at all costs! Please always keep a sufficient distance to the other tour participants, do not drive too fast, avoid reversing, swinging as well as abrupt turns with the Segway.

4.5 The guide has the right to exclude participants who violate the safety instructions or endanger themselves and others by their driving style from further participation in the tour. In this case, there will be no refund of the tour price. In addition, there are no claims for damages.

4.6 If you fail to follow the safety instructions of our guides and cause damage to the Segway due to your driving errors, you will be liable for the resulting damages, including consequential damages such as loss of income, unless the damage is settled by the Segway's liability or comprehensive insurance. (see also No. 5 to 8 of these GTC).

Disclaimer

5.1 The use of the Segways provided by us and the participation in a Segway tour is only permitted to those who meet the participation requirements and have accepted the disclaimer without limitation by their signature.

5.2 Customer's Liability Statement:

Participation in the briefing and the Segway tour is at your own risk.
There is no accident insurance for the participants and therefore there is no damage settlement in this regard by

A driver's license is no longer necessary since 15.06.2019
The minimum weight for using the Segway is 45 kg and the maximum weight is 118 kg.
In case of certain illnesses (epilepsy, thrombosis, cardiovascular diseases, etc.), participation in the Segway tour is not recommended.
Driving the Segway under the influence of alcohol or other drugs is not permitted.
There is no legal obligation to wear a helmet. For safety reasons

only tours with helmets. These can be used with pleasure or rented for 2, - € on site.

Damages to the personal belongings of the tour participant, which occur in the course of using a Segway, will be covered by

The customer is responsible for the consequences of traffic violations or crimes committed by him during the Segway tour and is liable for any damages, fees and costs incurred, unless he is not responsible for the traffic violation.
The Segways have liability insurance. The insurance coverage basically only includes property damage, personal injury and pure financial losses of third parties. Insurance coverage does not apply in the event of intentional, grossly negligent, or unlawful causation of the damage by the Customer. In this case the customer is liable without limitation.
If desired, a comprehensive insurance without SB can be concluded for an additional charge. However, the customer is liable without limitation for damages if they were caused by him intentionally or grossly negligent.
Liability

6.1 The Segway Tour Cologne & Segwaypoint-Düsseldorf & Seg-Events,

is liable according to the relevant legal regulations.

6.2 We are liable for damages - regardless of the legal grounds - in case of intent and gross negligence. In the event of simple negligence, we shall only be liable for damages resulting from injury to life, body or health as well as for damages resulting from the breach of an essential contractual obligation (the fulfillment of which is necessary for the proper execution of the contract and the observance of which the contractual partner may regularly rely on - so-called cardinal obligations); in this case, however, our liability shall be limited to the compensation of the foreseeable, typically occurring damage. This shall also apply to indirect consequential damages such as, in particular, loss of profit.

6.3 The above exclusions and limitations of liability shall apply to the same extent in favor of our employees, representatives and vicarious agents.

Liability insurance

7.1 Our Segways are insured within the scope of the statutory liability insurance. The insurance coverage generally includes only property damage, personal injury and pure financial loss of third parties. The insurance coverage does not apply in case of intentional, grossly negligent and unlawful causation of the damage by the customer. In this case the customer is liable without limitation. We are obligated to fill out a damage report and notify the police in the event of an accident, theft or other damaging event.

Comprehensive insurance

Generally, all equipment has only third party insurance. Liability for damage caused to the Segway during the tour or loss of the vehicle can be covered by paying a surcharge prior to the start of the tour at

can be additionally secured with a comprehensive insurance. For an additional charge of 6,- EUR a fully comprehensive insurance without SB can be concluded. However, the customer is fully liable for damages, if they were caused by him intentionally or grossly negligent. Note: It is in the customer's own interest to check whether and to what extent his private liability insurance or, in the case of companies, the company liability insurance covers damage events.

Offers, Orders

9.1 Our offers are subject to change.

9.2 Orders placed are binding for the customer.

Terms of payment

10.1 Unless otherwise stated in the order confirmation or invoice, the invoice amount is due for payment in advance without deductions. Only with the payment the reservation gets its validity.

10.2 In the event of default in payment, interest on arrears shall be payable at a rate of two percent above the current discount rate of the Deutsche Bundesbank. After default a fee of 5,00 € will be charged for each reminder.

10.3 This shall not exclude the assertion of further damage caused by default. All our claims shall become due immediately if the payment deadline for a claim is not met.

10.4 Offsetting against counterclaims is not permitted. The Buyer shall also not be entitled to a right of retention due to disputed counterclaims or due to claims arising from another contractual relationship.

10.5 Customers who act on behalf of third parties are not entitled to any claims against

Cancellation or rebooking on the part of the customer

In case of cancellation or rebooking of a tour booking (only for online bookings via our booking program) the following rebooking and cancellation conditions apply:

Rebookings are always free of charge up to 72 hours before the start of the tour, after that rebookings are no longer possible
Cancellations made within 7 days before the start of the tour will incur a 100% cancellation fee.

If a cancellation is made, the full tour price will be refunded (except for payment by credit card + instant bank transfer, a processing fee of 5% will be charged).

Cancellation can only be made in writing (by e-mail) The above cancellation fees also apply to the reduction of agreed number of participants. For commercial customers and individual tours, if this was not booked through our booking system, different cancellation conditions apply. In this case, the cancellation conditions according to the offer or order apply.

12.4 If a technical defect occurs on the Segway before or during the Tour for which the Participant is not liable, the Segway Tour Cologne & Segwaypoint will attempt to repair the Segway.

to provide a replacement vehicle. If this cannot be provided, the participant will be refunded the full tour price. The participant has no additional claim for damages. This also applies to the other tour participants who had to accept a tour delay due to the technical damage.

12.5 If a Tour has to be cancelled, especially in case of sudden bad weather, injuries of customers or due to other important reasons, the customer will be refunded the Tour price paid by him. This does not apply if the tour has already lasted one hour or if the customer has been excluded from continuing the tour according to No. 4.5.

Rebooking

Rebookings are free of charge if the start time of the tour is more than 72 hours.

Due to high demand, the start time can be postponed (e.g. if a large tour has taken place before, illness of a guide, breakdown).

has the right to postpone the start time up to two hours (earlier or later). A cancellation of the booking is not possible.

will make sure that the customer is informed in time (if possible 1-2 days before the tour). In exceptional cases, a postponement can also be made at short notice. In case of a postponement of more than one hour, the customer can either rebook or cancel the booking.

Data storage

14.1 Your personal data will be used exclusively for the processing of your orders and will not be passed on to third parties. Your data is subject to the Federal Data Protection Act and other data protection regulations. Your personal data, such as name and address, will only be transmitted in encrypted form. According to § 34 BDSG you have the right to information about your data stored by us and according to § 35 BDSG the right to correct incorrect data or delete / block inadmissibly stored data. 14.3 The contractual partner agrees that photos and video recordings, which do not violate the personal rights of participants, may be used for advertising purposes. We request a refusal in writing by mail, fax or e-mail.

Severability clause

Should individual provisions of the contract be or become invalid, this shall not affect the remaining content of this contract. The contracting parties will work together in partnership to find a provision that comes as close as possible to the invalid provisions.

When paying by "Sofortüberweisung", your PIN and TAN are transmitted to Sofort GmbH.
